General terms and conditions of sale
D-itshop.eu (the “Website”) is an online store operated by Trama Geometrica Unipessoal Lda. Throughout the Website, including these terms and conditions, the terms “Seller” “we”, “us” and “our” refer to Trama Geometrica Unipessoal Lda and the terms “Customer” or “you” refers to any purchaser of goods or services through the Website. The Seller offers this Website, including all information, tools and products available from this site to you, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
1 TRADE POLICY
1.1 The Seller has products for sale on the Website. The products and services for sale on the Website are available exclusively to end users who are Consumers. "Consumer" in this context means an individual who is acting/buying outside of their business or profession. If you are not a "Consumer" we ask that you do not make purchases from the Website but instead contact us direct for business to business sales.
1.2 Seller reserves the right not to process orders received from users who are not Consumers or those that do not comply with Seller's general conditions of sale.
1.3 These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of orders placed on the Website between Customers and the Seller.
1.4 The Customer shall provide the Seller with a correct and complete e-mail address or other contact details and accepts that the Seller may contact him/ her using these details if it deems necessary.
2 HOW TO ORDER
2.1 To order from the Website, the Customer must have an e-mail account and their browser must be configured to accept cookies and pop-ups, in order to be able to enjoy all the navigability conditions of the Website.
2.2 Placing an order on the Website is easy:
· Find the products you want to buy;
· Add the selected products to your basket;
· Checkout;
· Select the payment option;
· Review your order;
· Make the payment and confirm the order; and
· You will receive an order confirmation by e-mail.
Your order is confirmed when you select the "Confirm Payment" button (Checkout) at the end of the purchase process.
When the Seller receives your order, a message will appear on the screen with your order number and all the order details. The purchase agreement is finalized at that point.
An order confirmation is sent to your e-mail address. We suggest you print or download this copy for future reference.
We reserve the right, for any reason, not to accept your order, or to cancel it even after it has been automatically confirmed.
By submitting the order form you accept the general conditions of purchase, as well as other conditions on the Website, via links, including these general conditions and terms of use.
The Seller may not process orders that do not have a sufficient guarantee of good collection; when orders are incomplete or incorrect, or the products ordered are no longer available. In these cases, we will inform you by e-mail that the sales contract has not been concluded and that the Seller has not proceeded with the sale, specifying the reasons for this.
If the products presented on the Website are no longer available when you last access it or when the seller receives the order, the seller must inform you of their unavailability within 30 days of receiving the order.
If an order has been placed and payment made for products that are no longer available, the Seller will refund the money paid for the unavailable items.
2.3 Right not to accept the order or to cancel the purchase
The Seller reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been accepted by us), for any reason without liability for any damages or costs. Some reasons for us cancelling your order may include (but are not limited to):
● The product no longer being available/in stock;
● The billing information not being correct or verifiable;
● The order being flagged by our Security Systems as an incorrect order or an order susceptible to fraud;
● The transfer for payment of the order not being received by us within 5 days of accepting your order;
● If we think you're under 16;
● If we think you're a reseller; or
● It is not possible to deliver to the address provided.
2.4 Data verification
After receiving the order, we may carry out some checks on it before preparing it.
These checks may include address verification, credibility and fraud verification. In relation to fraud verification, we carry out partially automated checks on all orders to filter out transactions that are unusual, suspicious or identified as susceptible to fraud. Suspected fraud will be investigated and, if necessary, prosecuted. By confirming your order you agree to these conditions.
3 GUARANTEES AND PRODUCT PRICING
3.1 Payment methods
We do not accept any other payment method than those listed at the checkout. Please do not attempt to pay by any means other than those specified. If you do, we cannot be held responsible for loss of payment or any other damages that may result.
3.2 Payment processing
If you pay by credit card, we will deduct the amount due from your account immediately. In the case of payment by credit card, all details (e.g. card number or expiry date) will be sent by encrypted protocol to the company providing the remote electronic payment services, without third parties being able to access the information transmitted.
This information will not be used by Seller except to carry out the necessary procedures for the purchase or refund, in the event of a return, in accordance with the exercise of the right of return or to report cases of fraud to the police.
The purchase price of the products and the shipping costs, as indicated on the order form, will be charged to the current account when the purchased products are actually shipped.
4 ORDER SECURITY
4.1 The Website uses robust security technology.
Your payment information will be encrypted from the moment you enter it until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed.
The Seller shall not be liable for any damage suffered as a result of the use of electronic means of communication including, but not limited to, damage arising from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.
Payments can only be processed if the information to be used for invoicing can be verified.
5 RESERVATION OF TITLE
Seller retains ownership of the company's products until it has received full payment for all such products.
6 PRICING
6.1 VAT
The prices of the products displayed on the Website contain/include Value Added Tax (VAT). Shipping fees are applied per order. The exact price of the shipping fee will depend on the country where your order will be delivered.
Currency
All prices are quoted in euros.
6.2 Your total price
The total price specified in the final checkout menu includes taxes and shipping costs. Prices are quoted on the order confirmation, which you can print out or download for future use. Please only pay the exact amount specified in the order confirmation and make individual payments per order.
6.3 Price changes
The prices of the products shown on the Website are subject to change. Seller reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
6.4 Pricing errors
Please note that even though the Website is updated very carefully, it is possible that the pricing information on the website may contain errors. Seller does not commit to the offer and reserves the right to cancel your order in the event of such an error.
7 QUALITY AND GUARANTEE
Seller does not sell second-hand, defective or substandard products. The main characteristics of each product offered for sale on the Website can be found on the relevant product page.
The product images shown on the Website may not correspond exactly to the shipped item in terms of image and colours. This may be due to differences in the colour and image rendering of each Consumer’s computer equipment, Internet browser or other factors. We will not be liable provided that the item shipped complies with the description set out on the Website.
If you decide to exercise your right to return the products purchased, Seller has the right not to accept the return of products that have been altered from their original condition or damaged.
8 SHIPPING AND DELIVERY
8.1 Delivery: where and when
We deliver products from Monday to Friday from 9am to 5pm. We do not deliver on certain public holidays. We can only deliver an order if the delivery address is a home or office located in Portugal.
In order to receive the package, it is necessary to ensure that someone is at the address. This service does not include the option of scheduling or making an appointment, so the order may be delivered without prior contact from the carrier. We do not guarantee this deadline during periods of promotions, sales, Christmas or stock-outs.
A delivery is considered to have been made or a product is considered to have been delivered when the delivery receipt is signed at the agreed address or the courier otherwise confirms delivery of the product.
8.2 Delivery deadlines
Our products are advertised with an estimated shipping leadtime and we will endeavour to ship within this timeframe, if the product is in stock. (weekends and public holidays are not considered working days). Please note, some made to order and bespoke products will have individual delivery lead times listed on the website or communicated via our customer service.
The Seller shall not be liable for failure to perform, or delay in performing, any obligation due to a force majeure event, i.e. an event, act or omission beyond its reasonable control.
We will try to deliver on time, as far as is commercially reasonable. As a rule, we always do this, but we cannot guarantee timely delivery.
8.3 Partial deliveries
Whenever possible we will try to deliver everything in one shipment. However, we reserve the right to split the delivery of the order, for example (but not limited to) if part of the order is delayed or not available. In the event that we split the order, the customer will be notified by e-mail of our intention to do so. The e-mail address provided by the customer at the time of purchase will be used for this purpose.
8.4 Inspection upon delivery
Upon delivery, the customer must inspect the packaging for any damage. If the products are found to be damaged, the customer must not accept delivery of the order, which will be returned. The Seller will reimburse the amounts paid for the order and transportation as soon as the warehouse receives and completes the return process.
Any claim for non-receipt of an order must be made within a maximum of 30 days from the date the order was placed. After this period, the Seller cannot be held responsible for the loss of the order.
9 SHIPPING FEES
9.1 Shipping rates
Shipping Rates are applied per order.
RETURNS AND CANCELLATIONS
9.2 Cancellation of order before shipment
The customer can cancel the order as long as it has not yet been shipped. The customer must contact our Customer Service team at the following email address
[hello@d-itshop.eu] and ask for the order to be cancelled. Only after this procedure can our Customer Service team ask our warehouse to cancel the order.
Please note it will not be possible to cancel or return any items which have been made to order / customised. Please refer to individual items on the website to know if they are a made to order product / customisable prior to purchase.
If the cancellation request is successful, the Customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer. If the cancellation request is unsuccessful, the products will be sent to the Customer who, if they still wish to cancel the order, must refuse to accept them. The products will be returned, and, upon receipt, a refund will be processed.
9.3 Returning defective products
The Customer has the right to return the delivered products if they are found to be defective or otherwise non-compliant with the products ordered. Returns can be made within 30 days of receipt of the order. This does not affect your statutory rights. If your complaint is justified, the price and shipping costs will be refunded.
9.4 Return of products due to withdrawal
If for any reason you are not satisfied with the products you have ordered, you can return them within 15 calendar days of receipt for a refund, provided that the products are returned in their original condition. Returned items must be accompanied by the original invoice, all packaging, tags and any related accessories and instruction booklets. No refund will be processed for items that are returned incomplete, damaged, soiled or otherwise than in a 100% resaleable condition.
Where you choose to return a non-defective product, the shipping costs on your original purchase will not be refunded. This does not affect your statutory rights.
Please note it will not be possible to return any items which have been made to order / customised. Please refer to individual items on the website to know if they are a made to order product / customisable prior to purchase.

9.5 Returning gifts
It is currently not possible for someone who has received a product as a gift from someone else to return it. In this case, in order to return the product, you must contact the person who bought it so that they can return it, in accordance with these return conditions.
9.6 Exchange of products
To exchange an item for another, please contact our customer service team.
9.7 Return information.
If the reason for your return is the existence of a defect or non-conformity with the products ordered, the Seller will bear the shipping and return costs. If your return was made for reasons other than the justified existence of a defect or non-conformity of the products ordered, Seller will not reimburse the shipping costs charged on the original sale and the Consumer must bear the cost of return shipping.
Refunds will be made based on the method of payment. The Customer will receive the refund once the product(s) have been returned and processed.

CONDITIONS APPLICABLE TO PROMOTIONAL CODES
When used in accordance with the established rules, a promotional code entitles the user to take advantage of a promotion/discount relating to the purchase of a specific product or for a set of products, during the period indicated/associated with the promotional code/promotional campaign.
Promotional codes may only be used for online purchases made on the Website. The sale, exchange or donation of a promotional code is not permitted. The Customer holding the promotional code may not upload or make available a promotional code on any website or other public form of offer, donation, sale or exchange. The use of promotional codes for commercial purposes is not permitted.
Each promotional code is connected to the Seller brand. Use of the promotional code in connection with another brand, company or name is prohibited. It is also prohibited to use the promotional code in an illegal, abusive or disrespectful way, or in any other way that could damage Seller's reputation.
Use of a promotional code is limited to one use per product and per order.
Promotional codes cannot be combined with any other promotions or special offers.
Promotional codes are not exchangeable for cash.
Seller is under no obligation to reissue or refund promotional codes. However, in the event that Seller decides to reissue or refund a promotional code, it needs to have access to the initial promotional code. To do this, you need to keep a copy of your promo code, otherwise it cannot be reissued or replaced if it is lost.
In cases where Seller reissues/refunds the promotional code, the discount of that amount can only be applied to a purchase of equal or greater value to the purchase in which the discount/promotional code was issued.
Without prejudice to any other rights, the Seller has the right to immediately invalidate any promotional code if the Seller has reason to suspect that a promotional code is being used in breach of the aforementioned conditions or for any other reason, in the absolute discretion of the Seller.
11 AVAILABILITY
Fulfilment of all orders placed on the Website is subject to availability. The Seller tries to ensure that all items listed in stock on the Website are in stock. However, the Seller reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In such cases, Seller will inform the Customer and refund the amount paid.
12 VALIDITY OF OFFER
Offers on the Website are valid only for the time they are displayed on the Website, unless otherwise stated on the Website. The Seller is not bound by any offer if there are errors or mistakes in spelling, prices or other information on the Website. The Seller reserves the right to cancel any purchase or sale made as a result of such errors.
13 RESPONSIBILITY
The Seller shall only be liable for damages suffered by the Customer in the event that such damages result from attributable breaches of the Seller’s contractual obligations towards the Customer, or in the event that the Seller’s liability results from applicable statutory law.
In the event that the Customer has suffered damage related to the activity of the Website, Seller's liability shall be limited to:
● Damage to Seller products or other materials;
● Reasonable, necessary and verifiable costs incurred by the Customer to find the cause and amount of compensation attributable to the damage;
● The maximum reimbursement of the aforementioned compensation will be (if applicable) the price of the products in question.
The Seller shall not be liable for damages suffered by third parties as a result of the use of any of our products. In no event shall the Seller be liable for any damage suffered by the Customer as a result of improper use of our products.
Seller shall not be liable for damages resulting from incorrect information on the Website.
The foregoing does not affect your statutory rights or any liability that the Seller may have as a result of gross negligence or wilful misconduct on the part of Seller.
14 APPLICABLE LAW
These general conditions and all disputes arising in connection with these general conditions, including their validity, the use of the Website or any purchase on it shall be governed by Portuguese law.
15 AMENDMENT OF TERMS AND CONDITIONS
The Seller has the right to change these Terms & Conditions at any time. The Customer is subject to the principles and terms in force on the date of his/ her order, unless the law or competent authority imposes any change to them.
16 INFORMATION ON THE WEBSITE
Although the Seller works on its website with the utmost care, the information, texts, graphic documents, films, music and/or other services may contain errors or be incomplete or incorrect.
The Seller shall not be liable for any damages resulting from the use (or inability to use) the Website, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of wilful misconduct or negligence on the part of the Seller.
17 TRADEMARKS AND COPYRIGHT
All brand names, product names and titles used on the Website are trademarks or registered names of Seller or trademarks and registered names of other holders.
The user/Customer of the Website is not authorized to use or reproduce any of these trademarks or registered names as this constitutes an infringement of the rights of the owners.
Everything concerning the design, texts, documents, films, music and/or other services of the Website, the selection and organization thereof, as well as the entire compilation of software (including applets) and all other materials on the Website are the property of Seller and its suppliers.
Users/Customers are only authorized to electronically copy and print portions of the Website if this is necessary to place an order on it or to use the Website as a source for purchase.
The user/Customer is not authorized to make any other use of the Website or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication.
If the user/Customer wishes to use information or materials from the Website, they must obtain prior written authorization from Seller.
